Terms and Conditions
These Terms and Conditions ("Terms") govern your use of the Asizto India mobile application ("App"), developed and operated by Nikhil Codes ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. About the App
Asizto India is a personal health management application that allows users to:
- Track medicines and set dosage reminders
- Manage medical appointments
- Store emergency contact information
- Access an AI-powered health assistant (chatbot)
- Monitor personal health metrics such as BMI and health score
The App is provided completely free of charge. There are no subscription fees, in-app purchases, or hidden charges at this time.
2. Medical Disclaimer — Please Read Carefully
THE APP IS NOT A MEDICAL DEVICE, DIAGNOSTIC TOOL, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
- All content in the App, including health facts, AI chatbot responses, health scores, and BMI calculations, is provided for general informational and organizational purposes only.
- The AI chatbot powered by Google Gemini may produce inaccurate, incomplete, or outdated health information. Do not make medical decisions based solely on chatbot responses.
- Always consult a qualified and licensed medical professional before making any decisions related to your health, medications, or treatment.
- Medicine reminders are a convenience tool only. We are not responsible for missed doses, incorrect dosages, or any health consequences arising from reliance on the App's reminder system.
- In any medical emergency, call emergency services immediately (108 for ambulance in India). Do not rely solely on the App's emergency features.
3. Eligibility and User Accounts
3.1 Age
The App is intended for users of all ages. Users under the age of 18 should use the App only with the knowledge and supervision of a parent or legal guardian. By registering, a user under 18 confirms that their parent or guardian has consented to their use of the App.
3.2 Account Registration
You must provide a valid mobile phone number to create an account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts where false information has been provided.
3.4 One Account Per Person
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions is prohibited.
4. Privacy and Data Collection
4.1 What We Collect
To provide the App's functionality, we collect and store:
- Your name, phone number, and optionally your email address
- Health information you voluntarily enter: medicines, appointments, height, weight, blood group, medical conditions, and habits
- Emergency contact details you add
- Device information and usage data for crash reporting and performance
- Location data (only when you explicitly use the emergency feature to find nearby services)
4.2 How We Store It
Your data is stored on Google Firebase (Firestore and Firebase Authentication), which is hosted on Google's secure cloud infrastructure. Data is associated with your user account and is not shared with other users.
4.3 Third-Party Services
The App uses the following third-party services, each governed by their own privacy policies:
- Google Firebase (authentication and database)
- Google Gemini API (AI chatbot responses)
- Expo / EAS (app delivery and over-the-air updates)
4.4 No Sale of Data
We do not sell, rent, or trade your personal or health data to any third party for commercial purposes.
4.5 Data Deletion
You may delete your account and all associated data at any time from the Profile tab within the App. Upon deletion, your data will be permanently removed from our systems within 30 days.
4.6 Indian Law
The App is operated from India. By using the App, you consent to the collection and processing of your data in India in accordance with applicable Indian data protection laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (DPDPA) where applicable.
5. Sensitive Health Information
5.1 You voluntarily provide health information to the App to enable its features. This information is sensitive personal data under Indian law.
5.2 We process this data solely to provide you the features of the App and for no other purpose.
5.3 You have the right to access, correct, and delete the health information you have stored in the App at any time.
5.4 We do not use your health data to train AI models or for any research purpose without your explicit written consent.
6. AI Chatbot — Specific Terms
6.1 The chatbot feature uses Google Gemini, a large language model. Responses are generated automatically and are not reviewed by a medical professional.
6.2 The chatbot may occasionally produce responses that are factually incorrect, outdated, or not applicable to your specific situation. You acknowledge and accept this limitation.
6.3 Do not share highly sensitive personal information such as government ID numbers, banking details, or passwords with the chatbot.
6.4 We are not liable for any action taken or not taken based on chatbot responses.
7. Notifications and Reminders
7.1 By granting notification permissions, you consent to receive medicine reminders, appointment alerts, and app-related notifications.
7.2 Notification delivery depends on your device settings, operating system, network connectivity, and battery optimization settings. We cannot guarantee that every scheduled notification will be delivered.
7.3You may disable notifications at any time through your device settings or within the App. Disabling notifications will affect the App's core reminder functionality.
8. Emergency Features
8.1 The emergency contact and SOS SMS features are provided as a convenience tool only.
8.2SMS delivery depends on your mobile carrier, network availability, and the recipient's phone status. We cannot guarantee delivery of emergency SMS messages.
8.3Always call official emergency services (108, 112, or 1091) directly in a life-threatening situation. Do not rely solely on the App's emergency features.
8.4We are not liable for any harm arising from failure of the App's emergency features to function as expected.
9. User Responsibilities
You agree that you will not:
- Use the App for any unlawful purpose or in violation of any applicable law
- Attempt to reverse engineer, decompile, or extract source code from the App
- Use the App to transmit harmful, abusive, or offensive content
- Attempt to gain unauthorized access to other users' data
- Use automated tools, bots, or scripts to interact with the App
- Misuse the emergency features (including false SOS alerts)
- Impersonate another person or entity
10. Intellectual Property
10.1 All content, design, branding, logos, and software in the App are owned by or licensed to Asizto India and are protected by applicable intellectual property laws.
10.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device solely for personal, non-commercial purposes.
10.3 Nothing in these Terms transfers any intellectual property rights to you.
11. Availability and Updates
11.1 We reserve the right to modify, suspend, or discontinue the App or any feature at any time without prior notice.
11.2 We may push automatic updates to the App to fix bugs or improve functionality. Continued use of the App after an update constitutes acceptance of the updated version.
11.3 We do not guarantee that the App will be available at all times or that it will be free from errors or interruptions.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW:
12.1THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12.2 WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR HEALTH CONSEQUENCES.
12.3 OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM. SINCE THE APP IS CURRENTLY FREE, THIS AMOUNT IS ZERO.
12.4 SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless Asizto India and its developers, officers, and affiliates from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Any health consequence arising from reliance on App content
14. Termination
14.1 You may stop using the App and delete your account at any time.
14.2 We reserve the right to suspend or terminate your account without notice if you violate these Terms, misuse the App, or if we are required to do so by law.
14.3 Upon termination, your right to use the App ceases immediately. Sections 2, 5, 10, 12, 13, and 15 survive termination.
15. Governing Law and Dispute Resolution
15.1 These Terms are governed by the laws of India, without regard to conflict of law principles.
15.2 Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation by contacting us at the email address below.
15.3 If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India.
16. Changes to these Terms
16.1We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document.
16.2 For significant changes, we will notify you through the App or via your registered phone number or email.
16.3 Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
